Need Sincere Advice !!!

As many of you already know about my situation who was approved back in Feb 9th, 2006 but due to bio GC has never been produced to this date. But I made an info-pass on June 30th, 2006 & had my bio at the local office also got my passport stamped. IO at the local office told me to wait for 90 days & I should be receiving my GC. If not make another info-pass & talk to an IO at the local office.
It's only two weeks but do you folks suggest me to wait as IO told me or file a I-90 ( Application to Replace Permanent Resident card) at this time?

I was at the ASC for bio for last four times but Nebraska Service Center (NSC)
where my case was processed never received that ( Code 2) bio. But when at the local office I explained the IO everything & requested him to get my bio at the local office he did so along with two photos/signature & index print.

My second question is if I need to file that I-90 application what should I put in the PART 3 column? Where it says CITY OF Residence Where You Applied for an Immigrant Visa or Adjustment of Status? I reside in Arlington, TX but filed my application NSC where the case was finally processed & approved.
So what would be the answer Arlington, TX? Also on PART 2 of the application it says My Status is (a) Permanent Resident - ( Not a Commuter)
(b) Permanent Resident - ( Commuter)
(c) Conditional Resident.I know for sure that I'm not a Conditional Resident but what's that Commuter & not Commuter means? I think if I'm not wrong I should pick (a). What do you think? First of all please let me know if I really need to file this application & secondly if so than advice me what should I put on the application on those columns.

as I always think about you situation Atique and I dont want to ask you everyday to make you sad buddy.
Q1) I dont think it is a right way or wrong way, but I see it as a problem on your case which USCIS hasn't done a good job. If I were you, I would file I-90 because you have never got your GC or anything else and I would include a spread sheet explaining the situation for Nebraska Service Center and tell them that you have a feeling which filing I-90 probably is the best thing to do. You have to Point out every thing clear.

I am appalled to see what has been happening with you GC. It's not even the fact that you haven't gotten it yet, but the fact that USCIS continues to drag you into those BIO appointments and infopass, causes you stress, time, money and missing work, etc. - and NOTHING! Not a single valid explanation, not a single reason why this simple procedure of getting GC has been such a mess.

Please do not file any more applications, to avoid making it worse and more confusing for already confused and retarded USCIS. Go and file Writ of Mandamus immediately. We can all help you with that. If I were you, I would sue USCIS and ask for money for caused emotional stress and inconvenience. Again, it's not the fact that they haven't issued the card, it is this gross negligence that they have been showing on your case. Sue them!!!!!!

Like you, I am still waiting for my gc after approval. The different is that I received the actual gc, but it was damaged so I sent it back to the NSC along with I-90 application (as instructed by immigration officer). After an infopass appiontment and several phone calls, I decided to write to the NSC a status request of my I-90 application on June 1. The same day I made a last attempt to call the national service center, an officer recommended to re-file I-90 form. This officer was very helpful and nice. He even told me his name in case I need to use it for reference.

A couple weeks ago, I received a respond of my status request and was told that they could not locate my original I-90 application and asked to provide documentation of payment such as cancelled check. I did not pay for the original I-90 application because the gc was damaged when it arrived the officer told me no need to submit a payment.

I followed the advise of the officer, so I re-filed I-90 on June 1. I am glad that I did not wait to I re-file my I-90 application. Yesterday, I received a letter for BIO appiontment letter. At least something is going on.

Since you have gotten a stamping on your passport and the officer at your local officer already submitted your fingerprint on your behalf, it might make sense for you to wait (my personal opinion
). But I do suggest that you write them a letter and ask for the status of your gc.

Cchong, You are right I think I should wait sometime. But about writing to USCIS regarding my case status? I've mailed two letters to USCIS & one to Ombudsman inquiring about my case status two months but yet no reply to this date. Finally Senators office made a inquiry on June 19th on my behalf & I'm waiting to hear from that response. Cause USCIS surely can ignore us but got to act on US Senators for sure.
Last time when Senator's office made an inquiry back in May USCIS ( NSC)'s response was I was scheduled to appear for the Biometrics ( Code 2 for GC production) on May 4th & their records shows I didn't appear there so card cannot be produced without Bio. But that was completely wrong cause I was there as scheduled & I explained that to the Senator's staff also mail his office the copy of that appointment letter with ASC's processing stamp on it.
Since this time local office IO again had my Bio taken upon Senator's office's request & IO said he'll mail that therefore I think I should allow sometime.
My info-pass was on Friday June 30 after that SAT/SUN was off day & Tuesday was 4th July holiday therefore that whole week I don't think anything happened. I'm hopeful this time. Let's see what's in my fate this time!!
