Need opinion -Urgent

I am completing 6 years of my H1B on Nov 16th. My I140 is pending with NSC since Apr 30th and did filed I485 on 14th of Aug(ND). I am done with FP (Sep 25th) and I did received AP (Ad Sep14th).

The way NSC is handling I140 and what I am hearing, that INS is not going to Process EAD till they process I140, its looks like I may not be authorized to work after Nov 16th, though my status is legal as I had applied for I485.

I have two alternative:

1. Get an Interim EAD from Local office, that's what my company is telling me to do.
2. Apply for H1 Extension. Here I have to do premium processing $2200 + Attroney fee. Too expensive for my company.

Is option 1 is a right option for me ? My company is telling me to use this option or take "absense of leave"

You know your situation best!

Obviously you have only three options:

1. Apply for iEAD
2. Apply for an extension of H1
3. Go on a leave of absence

You should know what your priorities are and based upon them you have to make your decision.

If you want to work and make money (not a bad idea) then it is obviously option 1 since option 2 is too expensive for you.

If you prefer to stay at home and take a break from the rat race while contemplating the mysteries of the Universe then it is option 3 since option 1 and 2 won't help you do the same.

1. I doubt if you can get an EAD. As your I-140 is not yet approved.
2. I think this is your best bet unless you want to stay home without pay. Curious why do you have to do a premium processing and why not a regular extension?
 
I agree with 140_takes_4ever,

But As you already posted question, I just want to remove one mis understanding. You don't need to have H1 ext approval before current h1 expire,

Legally you can apply one day before your current h1 expire, but again, if it simple h1 extention case you might not need lawyer, You can do everything working with HR to save lawyer fee, here is link which can get you kit for h1 apporval. (I would think lawyer is better option, but if you want to try money saving option then this is better than nothing.) So if you apply before your h1 expire that would be enough to continue your work.
