Need information about H-1B process

Hi Friends,

I am planing to bring my brother from India who is working in Satyam Computers in Hyderabad. When will be new H-1B visas avaiable and when we can start processing for H-1B filing.

I have contacted one consultant and he said that it will be charged $3600 for the H-1B filing. I don't know whether its correct or not.

I would be thankful if anybody can give the suggestion aout this issue.

USCIS will start accepting H1B application from April 1, 2008 for the FY starting 2008-Oct. But generally the cap is filled up almost immediately within a day or two.

$3600 sounds about right for the lawyer's charge. It may cost another $1K for PP.

I heard that in one day H-1B allications will be sent to USCIS more that quota allotted by USCIS, Will USCIS refund the amount to applicats who's applications have not been taken.

What is PP.

Sorry, PP is premium processing. USCIS will process your case in 15 days if you pay $1000 additional fee. However, if the quota is over, they will refund the fees. But the lawyers' office may not, i have no idea. If you go to the USCIS website you should get all these info.
 
Unless new law passes next year (highly unlikely), what you will need to do first is to find your brother a job in the U.S. and the employer is willing to apply for H1B on behalf of him. Note that those consulting companies who hired thousands of H1B workers without actual "jobs" have been under fire for almost a year, and many were caught cheating. Do a thorough research on the company before you pay them any money.

Next is to get all the paperwork ready and file I-129 on the first day, April 1, 2008, and hope to win the lottery. Check here for some common H1B questions, and here for USCIS instructions for filling out the form.

BTW, premium processing doesn't make too much sense for NEW filings any more, as you can't start working for six months after all.

Ok, now I understand what he meant by consultant...I was under the impression that he's talking about a lawyer firm and their fees for preparing and filing H1B and he's bringing his brother for working for his own company. I completely agree with you that it's cheating by these so called consulting companies for sponsoring H1b without a job. lots of eligible good workers, recently graduated students including higher degrees suffer for this as the quota fills up so quickly.

Thanks for your information. I wish I had a software company but I am scientist in Pharmaceutical Company. I don't have any intention of switching fields after working so hard to obtain Ph.D in Organic Chemistry.

Don't worry still my brother has not decided yet.

Beware of any company that asks you to pay for the cost of a H1B; that is a good indication that the company is not following the law.

USCIS/Department of State expects the company to pay for the entire cost of the H1B petition (filing fee, lawyer fee etc). If they are bringing the employee from outside the US, the company should also pay for the airfare for the potential H1 employee and his/her family. They should also be prepared to pay the fare for that family when they return home at the of the temporary job.

My recommendation to your brother would be to apply for a job, get selected, and then let the company handle the H1B filing.
