need information about "Future employee category"

Hi Guys

Let me explain my situation about GC(Labor). My GC(Labor) was filed in Sept 2001 from MD State under "Future employee category". I am not working for that company, and I didn't have H1 with that company?.
How GC/Labor approval(filed under "Future Employee" rule) process will get effect with the
change in economy and changes in INS after Sept 11.

Please share info.

LC process is all about intent/ability from employer that they will hire you once GC petition is approved and intent from employee/beneficiery that he/she will take that offered position. Everything is about future......

If the person is already working for a sponsoring employer then it is easy to show or one can say implied that he will take that position in future. Things are bit different if beneficiery is currently not employed by sponsering employer. But nothing unusual, a lot of people have gone through that path and things went smooth for them.

Changed economy and 9/11 had affect on all LC applications. DOL is closely monitoring and taking more time time to approve a petition. It all depends on specifics of the case. "Future Employment" should not be a issue at LC stage. It could be at 140/485 stage.

at the I-140/485 stage?

I'm also planning to apply my GC through a different employer and intend to join after my GC gets approved.

INS may ask you why do you want to join once GC is approved, not when EAD is recieved. As you know one can file 140/485 concurrently and can apply for EAD at that time.........They can question your intent....
