Need Help!!

Hello,

My student visa expired in Dec 2000 and I was caught by the INS in Dec 2001. Later, I married a US citizen in Oct 2002 but unfortunately the marriage did not work and the divorce has been filed. We filed all the immigration papers at the same time in Oct but there has been no response.
If I take voluntary departure from the US, what will be the amount of time that I will be barred from re-entering the US since I have overstayed for more than 180 days after my student visa expired.

That's a darn long time. I heard that some rules have been changed, are you sure that it's still the same?

I know for sure that rules have recently been more stricken than relax. 245(i) is over and so are many amenesty programs. Go and ask any lawyer and he will tell you that your best bet now is to migrate to Canada and get PR in Canada and become Canadian Citizen.

I was wondering if a company hires me and sponsors me for an H-1 visa will I have to leave the US if I am under removal proceedings?
