My first case filed in Aug'02 (EB2) and I-140 is still pending. Later in Oct'07 I filed the 2nd case as a perm with the same employer and the labor got approved in Nov'07. Now, I have to file the I-140 for the 2nd case. I already completed 08 Yrs on the H1B.

Should I file the I-140 for the 2nd case (perm) ? Is it going to impact my old case at any stage?

What advantages, I have if New I-140 got approved prior to the old case?

Please suggest.

1st Case: Aug'02 (EB3)
Labor Approved - July'07
EAD Approved - Nov'07
I-131 ND - Nov'07
Finger Prints done - Dec'07
I-140 Pending

2nd case perm:
Oct'07 (EB3)
Labor Approved - Nov'07
 
I-140 premium processing is temporarily suspended. Yes, you can file multiple I-140s from the same company as per the following excerpt from Muthy Chat:
There is no legal prohibition for a person to file more than one I-140 petition, but the employer must have a bona fide job that the employee intends to fulfill and work on for that employer with the specific job title and duties. So the bona fide, good-faith intent of the parties may be questioned if a person claims to work in two different positions, both signed under oath, for the same employer.
