Recently my I140 was approved under EB3(regular) category, I will not be able to apply for I485 as my PD is DEC 97 for EB3.
Based on the suggestion from my attorney I had applied for LABOR under RIR.
Now, my LABOR under RIR has been approved. I want to know if I can apply for I485 under EB2 category using I140 from EB3 ? what would be my PD? is there a problem in doing so?
