Guys,
I need help. I am planning to call my parents to visit USA for 2/3 months and would like to know what documents do i need to send since i am working on EAD and appllied for 140 / 485. Since if some one is on H1 he can send his h1 visa or approved petition as supporting docs.
Please let me know asap.

maza91,

My in-laws got their visitor's visa approved last week w/o any problem.

My H1 and I-94 are expired. I am on EAD pending AOS approval. I sent copies of EAD, AP and I-485 receipts(both mine and spouse) in substitution to I-94 and Visa. I don't know, if EAD/AP are required, but it never hurts to have more supporting docs.

Guys, as far as I know, it is in most cases individual's ability in India (who is applying for visa) to show/prove his/her ties with the home country. Documents from here help as far as financial responsibility is concerned. Other documents do not have weightage unless it is a formal sponsorship

Question for Sanga

Sanga,

Please help - I have explained my situation below.

1. Expecting a Baby in January.
2. Mother was going to appear for VISA this week.
3. My current status.
* Working on H1 - VISA extension not stamped in passport.
* Agent says VISA in passport is necessary only I-797 won't work for getting visitor VISA for mother.
* I-140/I-485 applied in February 2003. I have a valid EAD. (not using it) : I140 not yet approved.

I am considering following options for the quickest possibel turn-around of the issue - so that mother can be called in time.

1. Go to Canada and get stamping. - Do they still do it?
2. Instead of using my VISA for my mother's VISA, use AOS and EAD. (As you know I am not using it - can this pose any risks?)
3. Make a quick India visit for a week and get stamping there - can I get stamping within a week in India?

Please help me here - early responses appreciated.

Believe...'

Do not panic.. As some one mentioned int he forum just send the 140/485/ead receipts photocopies, go to www.immihelp.com. Everything is clearly mentioned there, that's what I did everything worked fine. DO NOT FORGET TO SEND AFFIDAVIT OF SUPPORT FROM YOUR SIDE.

Good Luck

Dont panic...

I had a similar situation like yours..

My h-1 Visa stamp expired.

I sent my I-797, I-94 photocopies and my parents got visitor visa without any problem.

I think having a Valid H-1 Visa stamp is required to get a H4..I am not sure regarding this too....

Dont mention in your invitation letter anything related to pregnancy etc etc...Just mention that you are inviting your mother to see USA.

Thanks to all

for your replies and suggestions.

My mother will appear for VISA sometime this week. Wish me luck.

Yes, I have not mentioned anything about pregnancy. I am hopeful that I-797 and all other required documentation should convince them.

Waiting with my fingers crossed.

Thanks again.
