Need Help with I485

Hi Gurus,

I have two labors, one is old conventional which just got approved today after 5 years and 8 months and the second one is perm which has i140 also approved but with a much later date of 2005.

Now, my lawyer is suggesting me to to file 2 I485 for which he charges almost 5 k including USCIS fees.

What I was thinking was maybe file I140 under premiun and have it approved in 15-20 days and then file I485 using the old PD. Please suggest, if there is any downside with processing i140 premium other than giving uscis $1000.

Please advise.

You don't need to file 2 I-485s. Just file one with your approved Perm based labor and I-140, so that you don't miss the boat. In parallel to this, you can file I-140 for your other labor. That's upto you if you want to file the other I-140 under Premium process or regular one.

The important point here is that you can use your other I-140 (once it is get approved) and capture the earlier priority date by using the option called "Interfiling". Interfiling is basically a way, where you can use 2 I-140 for 1 I-485. You just need to let the USCIS know, that you want to use the other I-140 as well.

Don't waste your money and DO NOT WAIT for the I-140 to be approved, which you haven't filed yet. You never know, if you get an RFP on that or not.
