Need advice. My husband has been denied the petition for adjustment of status for two reasons.
First because he send his paspport back to his country to get it stamped before his visa expired. he never left the US. the lawyer said that that was a common issue or mistake and that we will have to file for a waiver, we did.
the second reason was because immigration cannot find evidence that he came legally to the country even though the passport has the stamp from then when he entered. they only have another entry registered back in 1999, but not the one we need for 2003. he lost his I-94 for 2003. Basically it is their mistake that they don't have that entry.
We are planning to appeal in less than 30 days as required. We are very scare and would like to know if you have had any experiences of this kind.
