Hi,

In the process of securing a family based green card sponsored by my husband, the first stage I130 has been approved for my son and myself, for which I got a mail. Now the next process seems to be I864. I would greatly appreciate if anybody can help me out with saying how long it takes for this stage to be processed and how long it would take in total for me to secure the green card? Has anybody undergone these processes?

Thanks,
Sujata Vijayakumar

I believe you are talking about consular processing. Is your husband a Green card holder or US citizen?

If he is a citizen then yourself and son (under 21) are immediate relatives. After I130 approval, you will hear from NVC in 4-6 weeks about next steps DS3032, I-864, DS230 etc. The total process at NVC can be completed in 3-4 months, if you do your part on time. Then files will be forwarded to overseas consulate for interview.

If he is a GC holder, you have to wait till your category is current per visa bulletin before your immigrant visa will be approved.

Dear Visaapplicant:

Thank you very much for your reply. My husband became a citizen of US 7 months back. I was very much worried about the processing time as my husband says the schools open by August third week there and if the process gets delayed my son who is in 4th std. in India might end up in not getting admission into schools, thereby wasting a whole year. Do schools give new admission to children even in the middle of the year there?

Thanks,
Sujata Vijayakumar
