NEED HELP URGENT H1 > unemployed for 35 days > Job offer again

Hi all


I am currently on my 2nd H1b Visa was working for lets say company A. I sent my passport along with the aprooval notice in to get the visa stamped in St. Louis and they sent it back saying pics were not the right kind. Before i could send the passport back I got layed off. this was lets say May 5th.
Now I have another Job with company B who is willing to do my H1B visa ..... lets say 40 days have elapsed since i lost my job. I am currently getting a pay check from Company A ( a severance pay == my orignal pay) the new job is doing almost the same thing as i did at my old job



WHAT DO I DO ? WHAT IS THE PROCESS .... One particular attorney told me i need to go to india to get the visa stamped and oly then can i start work where as i contacted 3-4 different attorneys who said , i can start work as soon as my papers are filed and i can send the papers to St. Louis to get stamped....

If you have current pay stubs from company A, then do an H1 transfer. You don't have to go to India before starting work. If you don't have current pay stubs then INS may approve your H1 application without I94, in that case you have to go out of US and get H1 stamp before you can start work for new company. You can start working as soon as you get receipt notice. You can also do premium processing by paying extra $1000, you will get approval notice in 2 weeks.

I did speak to a very well known attorney abt this and as long as i have a pay stub and go in for premium processing i can start work the day i get the recipt from the INS whis is the very next day
