Gurus,

Please Help.

I received an RFE for my wife's AP on 01/05/03 requesting for copy of I-140 or the SRC no. The onlise status did not change, it still shows it will take 150 to 180 days to process this case.

I applied for the AP on my own and did not go through my lawyer. Do I need the lawyers assistance for responding to the RFE?
Is there any specific template for responding to the RFE?

Also I have changed my employer 18 months after the I-485 ND. But I have not notified INS about the job change. Should I inform the job change (letter from new employer) in my response to RFE?

AP details:
ND: 05/21/01
Office No# 026

I-485 details:
ND: 07/23/01

Thanks in advance.

Absolutely, NOT! I had an attorney, yet, INS thought I was my own attorney and sent the RFE directly to me :D. So, I responded back with a covering-letter and the I-140 copy (APPROVAL NOTICE) as well as the I-485 (RECEIPT NOTICE). Keep the Officer's statement as the first page. Also include the INS' covering letter, because that is what mentions the list of evidences needed. Send them through USPS with a return-receipt.

Thanks for the info.

In the letter it says:

Please provide a copy of the 797 approval notice for an approved I-140 or I-360,
OR
You may provide the SRC# of the I-140 or I-360 if a 797 is unavailable.

I have the I-140 approval notice. I don't understand about the 797 approval notice.

Since the RFE is for my wife's AP, the A# on the I-140 approval notice is different. Do I need to attach a copy of the marriage certificate? Also do I need to attach copies of previously approved APs?

Thanks

You will find the approved I-797 as kind of a green-color I-94. This is what you would have got when your employer would have filed for your H1.

Since the notice asks for an approved I-140, which you have, attach a copy of that as well.

Even my I-140 has a different A#, even though my I-140 Amendment has my right A#. So, don't worry about that. Optionally, you may attach your civic marriage certificate as well as approved APs, even though it is not needed.

All you need is to attach your approved I-140. That is all.

i am a new member on this forum...

Applied 2nd AP for me and wife at TSC in June.
We both got an RFE for a copy of form I 140 today.
I485 EB2 RD 9/01

I added my wife to my GC app only during the 485 stage
Hence my I140 approval only has my name and A#.
i am confused on how to respond tomy wife's RFE.

Should i just include a copy of my I140 approval and our I485 receipts and provide an explanation or is there anything else ishould include?

Sorry if this question has already been answered...
I would appreicate if someone can clarify.

Thanks
