Need Help RFE AUG-02

Need Help Attorney not helpful.


Filed my 485 with company A, left the company A after 140 approved, he never filed AC-21. And he worked with 3 companys after he left company A.


This is Exact RFE he got, please advice

The documentation submitted is not sufficient to warrant favorable consideration of your petition/application. The following information is required.

1. You have submitted copies of approval notices for petitions filed by company B and Company C. Service records indicate another petition was approved in your behalf that was filed by compnay D. You do not show the employment with any of these companies on your Biographic Information Form G-325. You state you began employment with Company A in July 1998 but the earliest approval notice from that company is dated September 1998. Please clarify your employment history, giving specific beginning and ending dates with each employer.

---- FYI he never applied for H1 from company D, His cousin (Same name like his had H1 from that company) very weird. looks like they are trying to search petitions by name . :eek:

2. Submit a currently issued letter or other evidence from the prospective permanent employer that indicates your current position, if any, your proffered position, and proffered wage and indicating that the terms and conditions of the employment petition continue to exist.

If you have changed employer since filing your application for adjustment of status, the letter shall be issued by your current and new prospective permanent employer. This letter must specify the duties of the position, requirements of the position, job title, wage, and the date you actually began employment. This letter should be issued by an appropriate authority within the organization that has ability to confirm the job offer.

3.The supplemental Form to I-693 that you have submitted states that you are not the appropriate age to obtain the vericella vaccination. Information available the Service indicates that everyone over the age of 12 months must either have the vaccination or be immune to the disease. The supplemental form is returned to you for your and the examining physician's convenience. You must return to the physician to obtain the vaccination or have the appropriate notation regarding your immunity noted on the form.

4. The document you have submitted as a birth certificate dies not include your mother's name and does not appear to be an official record of your birth. Submit a copy of your birth certificate showing your parentage which has been registered with the proper civil authorities of the country of your birth.

If your birth was not registered at the time, submit any secondary evidence in your possession to support the information you have provided about your birth and parentage. Secondary evidence will be evaluated for authenticity and credibility. Such evidence may take the form of historical evidence and must have been issued contemporaneously with the event which it documents. Such evidence may include, but is not limited to, medical records, school records, and religious documents. Affidavits may also be accepted provided that they are sworn to by persons who were born at the time of and who have personal knowledge of the event to which they attest. Any affidavits must contain the affiant's full name and address, date and place of birth, relationship to the party on whose behalf they are attesting, if any, and complete details concerning how the affiant acquired knowledge of event.


Guys/Girls please give some advice on the above questions.

This is like a std RFE- but too many issues. Issues 2,3,4 can easily be answred.
For 1 - just send employemnt history details along with W-2s and proper H1 etc documentation. This would take care of working illegally. From current employer get suitable EVL.
