I worked for one of the BIG 5 companies till March 2002 for almost 3 years. My Labor was filed in EB2-RIR status and got approval through this company and I-140 filed by this company was pending with the BCIS for the past November 2001.
Meanwhile the division/group I worked for this company was acquired by the current company (it is an acquisition) in March 2002. The new company filed for amended I-140 in March 2002 and the new company's atterney firm informed BCIS as it is the representative for my all GC related filings.
Meanwhile I received an RFE regarding the old I-140 filed by previous employer asking for "Why they need to consider to process in EB2 instead of EB3 since the experience letters did not reflect the complex responsibilities carried out and so on...". I sent revised experience letters from all my previous employers with detailed and complex responsibilities I carried out and my Masters degree certificate in May 2002. There is no news from BCIS regarding this I-140 so far.
Meanwhile I got amended I-140 approval in July 2002 and applied for I-485 based on the new I-140 approval in August 2002. I received EAD, AP and I travelled India twice after that..
My question is "Does the previous unapproved I-140 status filed by my previous employer has any impact on my I-485 adjudication?".
Since I was seeing some NOID's regarding filing in EB2 instead EB3 and I-140 related.
