Hi everybody,
I really need some advice on my issue. I have applied for H1-B visa with my indian passport. I recently got canadian citizenship and now I am a canadian with a canadian passport. Do I need to file for a new H1-B or what should I do when I go for stamping. Please help. Any advice is greatly appreciated.
Thanks,
Raj

You do not do anything with your H1B if your citizenship changes. Do you have your I-797? If yes, start using the cdn passport with the I-797 and tell the officer at the POE (if asked), that you changed your citizenship.

The issue of stamping does not exist for you as a cdn citizen. Because cdns do not require visa to enter the US. You enter the U.S. using your cdn passport and the I-797 as a proof of your H1 status.

Hi, everyone. Thanks for sharing all the information on the automatic revalidation rule!

I need your help. I know that a lot has been said about automatic revalidation rule, and by now I should feel comfortable going to Canada (I need to go there to "land" pursuant to my receipt of PR before April 2007) and returning to the United States. But there is one additional detail to my story.

I came to US as J1 student subject to rule 212(e) [2-year home residency requirement]. Then, without completing the requirement, I got F1 visa, graduated from college, and as of October 1, 2006 have H1-B status [I-797]. I cannot get H1-B visa because of section 212(e).

My question is: does anybody know if automatic revalidation will apply to me as well although I am subject to 212(e). [I do have an expired F1 visa and a valid I-94].

Nevermind...

Just in case anyone finds herself in the same situation:

I did go to Canada despite my 212 (e) requirement and came back to the States 4 days later using automatic revalidation rule and my expired F1 visa (although I am currently in H1-B status). No questions asked.

Good luck to everyone
