Hi Guys..
Have a strange prob.. so here it goes.
I have applied for LC-Sub and applied for my 140 which was approved in May'07.
Have also applied for my 485 in Jul'07 as the priority dates were current and waiting for a receipt#.
But now the prob is my employer wants to cancel my applcn as they want the labor back to the original person for him to apply.
So i want to know till what stage is that possible and if so will it have any after
affects to me if i have to re-apply for fresh labor under PERM. Pls help guys.. Am in a lose-lose situation.

Unfortunately, at this point, your employer has the upper hand. If it had been 180 days from the receipt date of your I-485, you would have then been able to use AC21 portability.

Eversince DOL published regulations abolishing Labor substitution, I believe the validity of any labor (for the original applicant) is only for 180 days after its certification date. Also, please be advised that you would not be able to carry your 'Priority Date' for a future GC, in case your employer revokes your I-140 within 180 days from its receipt date.
