Need help - Pending 485 and 140 denied

Hello there,

I need your help to understand my options. Here is the brief summary of my case:

I' m on the eighth year of H1 ext and filed my 485 during Sep'07. In Feb 2008 my I-140 got denied because my company (recently merged with another company) didn't reply to REF on time. Today on 30th day of denial notice my company called me with the information that the 140 got denied.

Please help me to resolve my case with possible option available with me under such circumstance.

Your company messes up big time. They should've notified you IMMEDIATELY.
Talk to an attorney. A good one. Be ready to spend some $.
Most importantly, don't get too worried and maintain your peace of mind.

Am I eligible to extend H1 based on Approved Labor?

Also, per one attorney, Even If I start the whole process from beginning (Labor approval) I can keep my priority date based on approved Labor. Is this correct?

I do not know details of your case, but I see you looked for Lab Sub-s before.

If it is Lab Sub-s most probably that appeal will be denied, right away.

If I were you I would file new case from the scratch.
 
I personally think your company is trying to screw you over. And also they are a bunch of incompetent jerks. Contact a very good attorney immediately. In these situations, I would not think about $$ but rather long term goals (of getting GC). Let us know your status and updates.

One think I don't understand... doesn't attorney gets copy RFE as well. I thought attorney is the prime contract based on G-28 employer signed unless employer submitted I-140 without attorney.
