My current employeer e.g. "C" is in the process of filing a 3 year extension based on I-140 approval. I have just recd a email notification on 1-140 approval from my employeer. I joined this company in 2006. They filed my labor under perm in July 2006. I am about to complete my 6th year on "Feb 17th, 2007". My name is "Sarika Ashi Bansal"
So my name details are as follows:
1. Family Name : Bansal
2. Given Name : Sarika
3. Middle Initial : A
When employeer "C" filed for H1B transfer in 2006 they provided the data as follows:
1. Family Name : Bansal
2. Given Name : Sarika Ashi
3. Middle Initial :
so, My I-797 from from emplyeer "C" reads as
Beneficiary : Bansal, Sarika Ashi
where as when employeer A and B filed they provided the details as follows:
1. Family Name : Bansal
2. Given Name : Sarika
3. Middle Initial : A
so, My I-797 from from emplyeers "A" and "B" reads as
Beneficiary : Bansal, Sarika A.
which is correct.
My questions are as follows:
Shall my current employeer "C" should correct this time or do as they did previous time (which was wrong). My 6th year expires on 2/17/2007. I don't want to take any chance as I am very narrow on time.
If my employeer/attorney does not receive the physical I-140 approval in next few days, what are my options?
Usually how many days does it takes after a "courtesy email is recd"?, we recd courtesy email on 1/31/2007.
Can I stay back once my H1B extension is filed by 2/17/2007 or it has to be approved by then. i am planning to file under premium processing.
I will really appreciate comment/help regarding this matter.
