Need help !!! Labor Substitution doubt

Guys,

I am getting a pre-approved labor for Jan 2002 EB2 and Jan 2002 EB3. I completed my BE in 2000 and the labor demands BE + 5yrs expe. What you guys think shuld i go for it or file under EB3 pre-approved. As per employer hs says we can do it in EB2 but i want some 3rd party opinion.
Would appreciate if you can give some sugg.

As per my understanding as of PD (Jan 2002) for the labor you as going to use you should have the required experience. But double check with any attorney before taking a decision.
 
For EB3 my case is good, but for EB2 i do not have 5 yrs exp before PD. But as of tdy i do have. Also is it poss that i can apply in eb2 and then i can downgrade if ins says.
