NEED HELP In-person Expedite?

Hi experts,

I had applied for I-765 in Oct 2003, and got interim EAD on Jan 22, 2004. This expires Sep 17, 2004.

However, my I-765 case has been pending at VSC with the same 60-90 day message, so I started an inquiry in April about it. Yesterday I got a letter saying that VSC has terminated action on my case since I got the interim EAD!!

My attorney (Fragomen) says that she will prepare a new I-765 application and request an in-person expedite (i.e., she will go to VSC and request them to expedite it). Does anyone have experience with this procedure, and can you give opinion on the chances of success?

Thank You!

gc-despo,

I am not sure of this, but can you go for a new iEAD once the present one expires ? If so, the pending EAD may be a boon in disguise, coz you can keep getting iEAD, without having to spend anything on them !

I was in a similar situation. Mine was filed in Feb 2004 but didn't get approved in time and I had to get an iEAD at the local office. My last-updated-date for I765 changed the day I got it so the VSC found it out almost immediately. After that my application continued pending at the VSC for at least two more months without any particular reason. I had my lawyer call them at the end of June and she got approximately the same answer - no action is being taken because I received and iEAD. She insisted that the iEAD is only temporary and we still need the main EAD to be approved. I got a card in the mail three days later.

Fragomen screwed up my applications several times also! The biggest immi law firm in the country; that is why I applied for third EAD and AP for myself and my wife on my own: All approved.
