need to apply GC for my wife

Hello,
Thanks for every ones help. With your help I have applied for my naturalization and now july 13th is my interview date.

Now my question is that I am willing to apply GC for her and when is the best time to apply that? Can I apply I-130 now when my process is still in pending. Once my naturalization becomes approved then will my wifes I 130 starts processing. Bcz this might help me to save some money for application fees as they are going up from july 30. Now she is on L1b visa and its valid till aug 2008.

Thanks in advance

Wait

I would wait till I become citizen. Get your citizenship certificate first and then file for your wife's GC. After you become citizen, it will speed up your wife's process so please wait another month. You are almost there. Good luck.

I think you can apply now as a GC holder and later "upgrade" your file once you become citizen. I am not 100% sure though.

Can anyone confirm this?

Hello guys,
Thanks for your advise. I will sure wait for one more month and will apply for her. Mean while I will just complete filling all the forms that needs to be.

Thanks again

Citizenship eligibility

Hello,
I have a question. One of my cousine who is also a GC holder and planning to apply for naturalization. Let me say about his case. He is also same as mine. He got GC in 2001 Mar and left to home country with reentry permit and came back in 2003 Nov 19th.
When he find with the lawer about the continues residency she told that he is now eligible to apply for GC.

Actually he should wait for 4 yrs 1 day to apply for Citizenship from the time when he was reentered to USA if I am correct. But the Lawer mentioned that he was already eligible 3 months before 4 yrs 1 day which is 3 yrs 9 months and 1 day from the time he reentered. Can some one clarify me is that tru that he can apply 3 months before the 4 yrs 1 day

The 4 year + 1 day rule applies to residents who have broken continuous residence. But to break continuous residence, you must have established residence. It is commonly admitted that residence is established once a person has elected residence within a USCIS District for three months.

The first question is whether your cousin has been residing for three months after receiving the Green Card in March 2001...
