My EB-1 pettition (I-140 and I-485) based on O1 visa were rejected. I do not have any underlying visa at this moment. Here are the details.
- My EB-1 was rejected on Jan 22nd 2005.
- I have an EAD valid till Aug 2005 (I know it doesen't make my stay legal)
- I am planning to stay in USA till end of May (kids education etc)
As a backup plan
- I have applied for a new O1 visa and waiting approval.
- I have to step out of the country to India (Chennai) for stamping.
Now that I have overstayed 4 months and worked
- what could I expect at Chennai consulate?
- what precautions do I take before I approach the consulate for stamping?
