Need Help - H1B Stamping Issue

My h1b and my wifes h4 is valid visa stamp is until Dec 29, 2002. This visa stamp is through my previous employer -A

I changed my job last year and got a I-797 approval until April, 2003 through my current employer.

I or my visa did not get the new visa stamping from my current employer. I was told as long as I have a valid H1B it is not an issue.

I and my wife will be levaing US and will be coming back on DEC 9, 2002 . This will be 20 days before my stamping expires. I was told to show my current I-797 and my visa through old employer to the US immigration officer.


My question is, Is there any way I or my wife will be denied entry into US because the visa stamp on our passport is valid only 20 days more. Will the immigration in Bombay can stop me??

My company is filing a new petition to extend my status after April, 2003. I am my wife are planning to get the new visa stamped after that new petion is approved, if possible.

You and your wife are fine. Be sure to get an I-94 based on your current employer upon re-entering the US.

Immigration in Bombay?? The INS does not have any office in Bombay. Unless there are undercover officers?!
