My name check is pending since april 1, 05 and july 21, 05 for family based 485. we have been interviewed twice- first in may 05 at saint louis and now in chicago on nov 8, 06 as we had moved while the name check is pending. Both times we were told approval once name check is over and we are still waiting. We had contacted senator now ex senator talent in saint louis and his office gave us the above dates with the same garbage from FBI - national interest versus individiual convenience and told us to wait. that was six months ago. now when we moved to chicago and received another interview call we thought name check was done but no still the same nonsense of still pending.
1) My question which senator is more helpful and can get something done - Obama or Durbin?
I have started processing my H1B and will probably go back on the H1 as I need little more stability rather than worrying every six months regarding the ead renewal. I have been told to wait for 90 days after interview on nov 8 and then call the officer who interviewed us if I do not get approval in 90 days. Once that is over and I do not have an approval I may consider writ of mandamus but before that want to exhaust all administrative options therfore the neeed for opinion regarding the senator.
2) Has anyone used rajiv khanna or shusterman or anyone else for writ of mandamus? I can think of these two only as I do not want to do it myself.
3) Any experience with lawyer charges and if I should wait longer. Feb 07 will be 2 years since we filed application.
4) Can they deny your application if you file a writ and if it is possible to just sue FBI rather than USCIS as they have done their job at least in my case by sending the name check request twice previously and now again she sent the request in front of us on Nov 8, 06 as she realized the marriage is genuine and the case is just sitting on her table for nothing and wanted to get the case done asap.
