Dear Friends,
I would like to know what is our status, are we a legal resident of USA or not? I am on H1 had applied I-485, application is still on process ,as we pay taxes and we maintain our legal status, if any one has any idea please share it.

What is the difference between Legal Permanent Resident and Legal Resident.

If you\'re H1 is valid, you are in status. There are two types of aliens - resident aliens (those with green cards, also known as permanent residents) and non-resident aliens (all those with H1, F1, etc.) So I would say you\'re in status, but not a permanent resident. You are a legal non-resident.

People who have filed I-485 hold "Adjustment to Permanent Resident" status. In other words, they are not yet fully qualified as "Permanent Resident" until they have approved I485.
