Need help. Domestic Violence

I have two questions.
Q1. My mother is applying N400. Couple of months ago my exwife went to police and complained false domestic violence and got TRO against her. but exwife took charges back in court and we got court dismissal. In N400, what should my mom say yes or no to the following.

16. Have you ever been arrested, cited or detained by any law enforcement officer
(including USCIS or former INS and military officers) for any reason?
17. Have you ever been charged with committing any crime or offense?

Q2. My mother is applying with my father. Can they both send forms in a single envolope or seperate. If single can they make single money order to two different for two applications.

I think (but I'm not a lawyer) that "it depends".

  • Was she arrested - did a police officer (or other officer) say "you are under arrest"?
  • Was she "cited" - was she ever given an official piece of paper that had the words "cite", "cited" or "citation" on it?
  • Was she detained - did a police (or other) officer prevent her from going somewhere?
  • Was she charged - did someone actually "charge" her with an offense?

Each of these verbs has a very strict legal meaning (my knowleged of which is gleaned mostly from years of watching "Law and Order").

Include two checks (which are easier to track than money orders), one for each application. The applications will be processed and tracked separately. Some people put each application in a separate envelope, and then put the two envelopes in a larger envelope. I didn't - I figured it was easier to keep them logically separate at every step.

And, for what it is worth, I suggest sending it "Certified Mail with Return Receipt" through the post office. Getting that little green post card back in the mail is very gratifying - it signals that your processing has started.
 
When I applied for my wife and myself, I sent both applications in one envelope but I enclosed two cheques, one for me and one for my wife.
