Need help...couple of questions...

:confused: Tried to find this answer in other posting but wasnt succesful so hope someone can help

1) For the Affidavit of Support form I-864 - In Section D #3: Determination of Eligibility based on income

# 3 states - Minimum income requirement from the poverty guidelines chart.....etc....which year should we use? '05' or '06'.....USCIS sent 2005 guidelines but it states that the figures for 2005 can be used up until spring of 2006...so i'm wondering if the new guidelines for 06' are already in effect? and for instance if there are 2 household members is the minimum $13,200? or we need to add any more $ figures to that? I hope i havnt sent anyone searching for stuff.

2) On the Processing sheet for Form I-485 who is the applicant me (the one adjusting status) or my spouse?

3)Your current non-immigrant class if any? wld that be out of status since my B1/B2 and I-94 has expired?

4) Next to I-94# they have Priority Date....wld that be priority date of my I-130 or what?

1) I864, we used the current 2006 figures I think. There is a poverty guideline sheet I believe on the USCIS website, but don't quote me on that. I think that's where we found it.

2) I (the immigrant) filled out the I485

3) No idea, sorry :(

4) Again, no idea :(

You should use 2005 since your latest tax returns reflect the income for 2005.
According to 2006 Poverty Guidelines for the famaly size 2 your minimum household income should be $ 16, 5000

If you apply for AOS then you are the applicant.

I put N/A ( I had an expired J-1 status)

4) Next to I-94# they have Priority Date....wld that be priority date of my I-130 or what?

Not sure about this one.

We used the 2006 poverty guideline chart.
For your current status, I would write: B2 (out of status).
About the Priority Date: I couldn't find that on the I-485. Where does it say??

Thanks for all the replys....myjuls and Patty579 was u'll forms accepted with the year u chose? So if we use the 2005 guidelines or the 2006 guidelines wld that affect anything if we chose the wrong one.

The Priority date is on the sheet that says Processing Form for the I-485 right next to Form I-94#......(it was sent to me along with the other forms from USICS .....i dont really know if i shld fill out this form. But it does state Applicant please complete all appicable information.

Another thing is dat i'm wondering since we are just filing the adjustment of status do we still send the I-485, I-864, I-765 to the chicago lock box. (not sure so pls dont bite my head off - cuz it states if u are filing concurrently) :D

But i really appreciate the responses.

In order to help you more efficiently, would you mind summarizing your case for us again, I think I read a couple of your threads before but I don't remember what it was about! See, I didn't fill out a processing sheet, so I don't know about that. Did you already file your I-130?

Use the 2006 guideline. Our forms were accepted, and I'm positive it's already effective. :)

Ok no problem:-

My husband was an LPR when he petitioned I-130 for me in 2001......I came up here in 2004 (B1/B2) went back after 6mths came back in Jan 2005 and i've been here since. Huband filed for N-400 in 2005....etc and he became a US citizen last thurs. Prior to this... we received an RFE re: I-130 for G-325A and p-photos which we sent to CSC a couple of days b4 the citizenship.

Since the citizenship we thought that we wld have had a smooth ride :D but its the other way round :rolleyes: ....etc.....sent request for upgrade of I-130 the same day of ceremony to CSC viz email which we thought ws where we had to send it to .....then were told by USCIS to send it to NVC which we have done....havnt recieved anything back since (no approval of I-130) but since he is a citizen now.....was told we can go right ahead and file I-485 package....which we are almost ready to send off...hence all the scratching of the head, biting off the nails, sleepless nights, etc and hence my last set of questions.....and where shld we send them to (I-485 - so we will just send the naturalization certificate along with it and the last update stating that the I-130 was sent to CSC, I-765, I-864, and the I-693)....trying to follow all the instructions from Ari4u's informative post (trust me its very helpful)...

wow, your case sounds pretty complicated!
Hm, unfortunately I am not very familiar with upgraded cases, so I don't really know where you should send your package. Does it say in the instructions?

As for the Priority Date, I'm really not sure either. I think it is the RN of your I-130.
I'm sorry I can't be of more help, but I'm sure that someone else here will be able to give you some input.

Well the priority date thing just kind of got me confused on the Processing Sheet For Form I-485, but, well, since i havnt read bout others filling out this processing sheet and u said u didnt fill out one i said, what the well and prayed to God and asked him to take away my paranoia. I just think all this thing has just gotten me on edge and paranoid. :eek:

So we both prayed and completed all the necessary forms, made copies for ourselves and my husband is gonna send them off 2day at his lunch time.

We sent the I-485 - along with a copy of his naturalization and a copy of the letter for upgrade that we had sent to NVC, I-765, G-325A, I-693 (medical),I-864 (he got it notarized at the bank)Sent the packages to Chicago Lock Box:-

The e-mail looks like the one I got after they received my RFE. So you don't have to worry about that anymore.
