Need Help - Change of Status - I539 (H1 to F1)

What should be my response to some of the questions on the Part 4 of the I539 form:

1. Are you an applicant of an immigrant visa or adjustment of status to permanent residence ?

2. Has an immigration petition been filed for you ?

While I was in the H1 status, Labor was filed for me (I never got a labor clearance in 10 months, which is another story). I never got on to the I140 or 485 stage.

So what should be my response ? I am sure many like me need to know the correct response to this question, because all the I539 for F1\'s will undergo tough scrutiny.

Also, any other knowleadgeable kind sould out there who would have tips on documentation that should be included in support of a change of status.

My list, in random order:

1. I 20
2. Bank statement showing ample funds
3. Cover letter explaining the change of status. (Very IMP)
4. Proof of ties to home country: I would include Bank Statements, property papers and last utility bills (if you have them - I am still maintaining an apartment back home)
5. Grade sheets of last semester I attended
6. Last 4 salary stubs
7. Previous approval H1 notice(s)
8. Letter of recco from college prof, if possible

Any inputs would be welcome - would benefit many.

Answer to GC question...

It is preferable to write "NO" for the Immigrant/permanent Residence" question as long as u haven\'t applied for I140. U r lucky in many ways bcos had u applied for I140 ur H1b to F1 would have been very very questionable.

Is "no" the "preferable" or the "correct" answer ?

In one the posts, you mentioned 4 statements - are they the bank statements ??

Your inputs on this issue is of immense use to a lot of people.
 
I am not sure...

But probably it\'s a good idea to include them to demonstrate that you were indeed maintaining status.
 
Time between last payment and I539

My last payment stub shows Oct 15 as the last payment date. I applies for the change of status on Nov 15. Will I have problems with them approving my change of status?
