My wife came here on L1 in March 2002 and has been in status, Her visa is valid until Aug 2005. Now, she has moved out of her company who sponsored L1 for her and I applied for H4 for her last week (efiled based on my H1B).
It will take sometime for the h4 approval to come thru, meanwhile can she apply for H1 in the April quota now ? (Or in the 20K new H1's coming sometime this month) ? or will she have to wait to apply till she gets h4 approval ? If she has to wait for H4 approval will H4 need to be stamped on her passport for her to apply H1 ?
