Hello Guys,
It is my first post , i will appriciate if someone can help me in this issue.

I got a Preapproved labour from my company and i applied concurrent to I-140 and I-485 in March-2005. (Not affected with Retro.) now as i have recieved my AP and EAD (I-140 is not approved yet as it is from NSC).

Now i want to visit my country and my H1B visa is not stamped. my laywer is saying that it is safe to visit on H1b Stamp instead of on AP as my I140 is not approved. And i am planning to go to Canada for visa stamping (as it takes much less time). Now the issue is that someone else told m that if u have approved Advance Parole and you stamp H1b, it means that u r choosing to withdraw your I-140 application and it will not be approved.

I want to know that how much this thing is true and should i go for H1b stamp or visit on AP?

Regards,
Stuck in NSC

There is no harm in getting H1B stamping while yr 140 is under process, as long as your are maintaining H1 status. In fact people prefer to maintain H1 status atleast untill 140 is approved, it's a back-up option in case there are any problems with 140.

Regards.
