I've been living with my fiance for 1 year now and we plan to get married. I want to find out more about his immigration status.
He came here in the year 2000 and was filed by his mother(who is a resident alien) and her american husband(who was and is still in prison). He was granted authorization to work in the United States along with a social seciuty card that says ( valid for work only with INS Authorization). He is on file to become a perminant resident. But due to missed appointments with INS because of his mothers husband being confined in prison, he is not sure of his current status. When he was originally filed in 2000 he was 15 years old and is now 21 years old.

After we get married what does he need to do in order to obtain a green card, perminant residnacy or citizenship?

His employment authorization card expired in March 11, 2003 but he was still able to work in the US due to the jobs not asking for his employment authorization card or to phisically see his SS card. But now he is being hired for a permamnent position with a company that requires him to have his employment authorization card due to the fact that his social security card has restrictions.
~What does he need to do in order to get a new imployment authorization card?
~Does he need to start over the filing process all over filing as an individual and forget about the filing he did with his mother now that he is 21?
After we get married what does he need to do from here regarding his employmnet authorization card and that is was expired march 11th 2003?
~ If this is an option, what can i do as his soon to be wife to help him?
What papers and forms of identification do i need? What papers does he need?
How long till after we marry should we wait being that we are in NY state?
How long after me sponsoring him does the process take for him to get either a green card, perminant residancy or citizenship?
Will we need a lawyer at any point to process any information?
What will the fee's vary at for a lawyer, if needed?

There are many issues involved in his case, and I could not possibly go into it all here. Because lots of important facts are missing with regards to his earlier case, I cannot really comment on it. His previous case may very well be abandoned.

I would imagine that if you were married, most of his problems should be resolved fairly easily. After filing I485 for him, he should be able to obtain EAD within approx. 3 months.

I would recommend getting an attorney in your area to look over your issues with you from the previous case and to advise you based on exact and precise facts. You do not need to hire an attorney all the way, you could schedule initial consultation and then see if you would need one beyond that. If this turns into a cookie-cutter marriage case you may not, but an attorney will advise you if there are any issues that need to be resolved with the earlier case that may be obstacles.
