Hi all,

I'm in the United States on H1 B Visa for the past 5 years. My green card is in process. In the meantime I'm planning to start a company. I'm seeking info on the following:

1. Can I register a LLC or S-corp firm under my name or should I register the
Company on my friend's name who is a US Citizen?

2. If I need to register under my friend's name how should I get the profits,
as I can't technically work for that company?

Thanks,
Wrangler

Thanks JoeF. That was quick. As my GC is having some complications am not using my EAD now and I'm continuing to be on H1 Visa.

As per your advise, an LLC firm can be registered in my name and I can be the owner. Should my friend be an employee of the firm or he/she needs to be a member of LLC to operate the firm? Can I also sign the official documents / papers and checks?

How do I get the dividends? please advise....

JoeF,

Your advise is of great help. Thank you so much. Now its clear that I can't work for the company, which also means I can't sign any document. So if I register the company(LLC) in my name, how can I employ an officer (CEO/member) to run the company as I can't sign any document for his/her employment in my company?

Please advise.

Thanks again..
