Hello all.,

My Friend who had an contacrt for 18 months with his Employer and he left that company within 12 months. Now the employer is trying to sue my friend almost after 1 year.

Can you please someone help me understand ...whether it is legal in this country to bound an employee.

It all depends on what is written on the contract. If he signed it, then he's bound to the terms and conditions of the contract.

Tell you friend to relax as his employer cannot sue against any employee who breaks a bond in between. Infact there is no such law to keep a bond between employer and employee in United States.

His employer is trying to scare your friend but he won't take any action. Why I am saying this, bcoz I personally seen my employer doing the some to other employee and he got screwed a big time from DOL.

Incase if employer sends some notice from lawyer for breaking the bond, tell your friend to contact a cheap lawyer and send employer a notice, that way he wont proceed further for sure.

This is just my opinion. Hope this helps.

Parvai,

Here in New Jersey (and in most of the Northeast) Department of Labor is favorable to employees , this means your buddy is safe here. Things could be slightly different in the Dixie states though.
