Need answers on this ASAP befoe filing 140/485

Could one person file for the above with approved LC if worked in the US without permission using a random SSN and paid Taxes etc?

Would this cause/denial any problem when USCIS processing the above forms?

Is there a forgiving thing here on employment based as a Marriage ?

Should he put that on the G-325 form that he did work WO Permission or just put that he was unmployed during such time ?

You help here would be greatly appreaciated .
 
Consult a good lawyer. Dont take any chances in this case. I 245 had a cut off date. Was the labor approved under I 245.
 
245(i) Filing

Yes I do have a lawyer not sure If I should mentioned this to her, Yes LC was approved under 245(i) , Just wanted to know if I should mentioned that I worked before without Permission.

---Your LC is approved, meaning you have to take it to next level by filing 140/485.
Since your LC is approved based on 245(i), gives illgeal immigrants a legal status. You used random SSN and paid taxes under your name, why didn't IRS bother your name and SSN validation when the tax purpose was satisfied???

---IRS and INS both are under different department. Its an amnesty for your, so INS should never inquire about your illegal staus.

---Since you fall under amnesty, your status not affect by forgiving thing.

---Mentioning it to lawyer won't harm anything. She is not going to tell USCIS about your past, instead she will help you out.

I also read somewhere on the 485 supplement form that you can only file under 245(i) if :
Worked WO permission
Overstay your permission
and more

so which means it's ok to work without permission if filed under the 245(i) I think , I'm getting mixed info .

As for all your other answers they seem to be correct .

---I am not sure where you are getting mixed up. The 245(i) is a granted asylum for those who don't have no documents to stay legal and/or worked without any EAD. Don't worry too much, and try to stop getting info from different individual. For better result consult with you attorney.

So then why is not good to list that one did worked ?????? if the 245(i) is there if you did any of the following:
1. work without permission
2. overstay your time given
3. and more etc

My attorney is saying to be honest and put that on the form Biographic form I'm also telling her to just put umemployed instead , now its since 96-present so she is thinking its quite a long time to be unemployed .

Let me know your thoughts on this Indria once again

---The reason I mentioned is because you said you used random SS# and received an employment during such period of time. Using random SS# to get a job is a serious crime against IRS. You could face even some time in court of doing such thing. That was the only reason I said not to discolse that information. In USCIS eyes, you must have worked without permission, and since you got your Labor cleared, you are good to go.

NEVER lie to USCIS

You should never, ever lie to the USCIS. If you do get caught, you're finished. Listen, your lawyer is telling you to be honest - why don't you listen to him/her? Instead you are taking advice from anonymous people on this board just because they are saying what you want to hear? If you do happen to get caught, your life will become significantly more complicated and you may be accused of perpetrating a fraud. All you have to do is read the 485 forums and you will find examples of people who did not tell the truth on various forms and paid for it.
