Need advise

Hi,

My mother came to US on 20 November 2005 on a 10 year visa. Her passport & I 94 are stamped as valid stay until 19 May 2006. I became an US citizen in February 2006 and immeadiatly applied for AOS for my mother (all at once I130 and I485) in March 2006. I recieved the notice date as 12 March 2006. Her finger prints were completed by 1 April 2006. Can she legally stay here until her I 485 is accepted. Recently in June we recieved an RFE for medical exam and we completed it and sent it back to INS. We have not heard anything from them till now.

Is my mother's current stay is still valid? Thanks in advance for your replies.

Your mom's stay is valid since she has a pending I-485 case. Her overstay wouldn't be a problem, anyway. You should have sent her medical with all the other forms. But, that's been fixed now. So, they would either send you the interview letter or the welcome letter followed by her green card.
Have you checked her status online?
 
Thank you for reply. I have checked the status online. It still says that we recieved the required information on 7 July 2006.

OK, so they did update her on-line status with the RFE received. You'll hear from them very soon.
