I know it is awfully long but i had to exlain in detail to make the experts understand. Thank you in advance.
My case History:
A. I came to this country on 18 Sep 2000. I applied my first green card with CompanyAin RIR in 2004. My priority date was June 2004.
B. In 2005 I had to leave that company (CompanyA ) and joined with the current employer CompanyB and applied for my Green Card in March 24 2005 in Traditional process EB3. Then I heard from the CompanyAgot letter from DOL that my labor was cleared. I am not sure what did the CompanyAreplied to DOL.
C. I had gone with Traditional process because my H1B 6 years was ending so I had to go in Traditional process to go for H1B 7th year extensions.
D. In June 2006, I received 45 day letter from Dallas Backlog Center and sent reply.
E. May 26,27,28 2007, we had ran the advertisements in Detroit Press as part of recruitment instruction from DOL.
Here are my questions:
1. Now as you know, all the process are current. But unfortunately my labor is not yet cleared. In this situation what will be your best suggestion to get my labor cleared?
2. Is there anyway I can use CompanyA labor certification? (Refer my point B above) I hope CompanyA Travel never asked DOL to cancel my labor because there are process and expense involved. I don’t believe CompanyA would have spent time and money to do that cancellation. Is there any way we can check the status of the old labor and if it is not cancelled, can we use it?
3. Is it advisable to change my case to PERM process to speed-up the labor certification?
4. Or do you think that I should stay with this Traditional process and wait for labor? Do you have any idea how much time it will take after the Advertisement to get the labor cleared in Traditional EB3 process?
