Hello Gurus,

I am in serious trouble. I am on bench in current company through which my GC is filed about 3 months back .In short they have put me on unpaid leave (i.e no pay slips).If I join a company through my IEAD just to get through the bad phase, will it create problem for the GC.
Current company has no problems in continuing my GC.
I will appreciate any help and advice.

3 months back ==> less than 180 days

You can change jobs if your application was pending more than 180 days.

Try to negociate with you company. This unpaid time (no paystubs) can affect your process (if you are requested to show your paystubs during interview/RFE )

Generally a person receives rfe for pay stubs/employment letter if it is not filed at the time of I-485 application

Do u remember if the pay stubs/employment letter have been filed ?

Also normally the rfe for pays stubs/employment letter comes 7-8 months after receipt date

also normally the interview call comes after 7-8 months

If I were in ur situation i would wait for 180 days to get over before doing anything

I am expecting the market to improve and maybe ur company finds work for you

It is excellent that they are telling u that they will not do anything
and are allowing u to continue gc application (but no pay on bench)

Wait for 180 days and then review the situation again

Also I feel that gc is for a future job and a lot of people are saying that as long as the company is willing to offer u a job at the time of adjudication then u r okay

Thanks a lot for your input. I know for sure that my lawyer filed 485 with employment letter.Yeah its good that my current employeer will keep the GC process intact.If I get a project they will start my pay.Its only that they are also in a bad situation.
I am just planning to work using my EAD on a part-time kind of stuff so that the financial situation does not get worse.
Is there always an RFE for pay stubbs or if the GC is filed with emplyment letter you straight get the approval?

I had a friend who had a similar expererience
He said that he asked his employer what would be the terms if he was able to find a project
The employer answered that if u find a project u get to keep 70 percent of the billing

So u could try to find projects on ur own also if u and ur employer are able to make an arrangement like this
You could try to negotiate between 85 percent to 70 percent

And start searching for assignments like that

I believe the market is going to improve

I am sure that in this way u will be definitely legal
