Hi

I really need advice on this issue because I'm uncertain about this..

I was on a visa in 2004 when I applied for a I-765 but didn't follow up the application. I then overstayed and fast forward to 2011 have a fiance. We plan to be married and then will file my papers to adjust my status here. Will that 2004 application for a work permit be a problem in getting my papers or will the case have been closed by now? I'm unsure. Do you think they will ask me about it in the interview? I still have the notice received in 2004 from the USCIS.

Your question is ambigious.

1. What type of visa did you come in with in 2004?
2. The I-765 application - Was it family based? How far did the process go before you
abandoned it? Why did you abandon?
3. IMO, the application for work permit back in 2004 will not impact your upcoming AOS
negatively.
4. They might ask you about it. No big deal. The main issue here is - why you abandoned to process. Did USCIS ask for information that you were unable to provide or something?
 
Yes. I came in on a visa waiver program. I applied through an organization called HACHO who said that they process applications for work permits and naively, I applied. I couldn't substantiate the request for additional information and then abandoned the application. I don't know if it would be a problem for my AOS application and interview.

Relax. I don't think you have much to worry about. Its not like you have a criminal hx.
There are thousands of folks out there that applied for work permits but had to abandon the process because they did not qualify or because they could not vanish the info requested. Some don't follow through because of utter ignorance.
Go ahead with the process. Consulting an immigration lawyer would not be a bad idea either.
