I work for an Software development company in Vienna VA.. My company has started my Green card processing in August 2002.. Here are my dates

Labor applied - Aug 2002
Labor cleared -Around Aug 2003
140 Cleared - Around Aug 2004
Applied for AOS or 485 in Dec 2004. I did received EAD and AP

I got married in Nov 2005 and was not able to add her to my GC application, due to retrogression..

Currently I am on H1 with a validity upto Oct 2008 and my wife on H4


There has been change in circumstances and I might have to look out for a new Job.. What I would like to know is..

How can I change my Job,

Question 1: Can I use by EAD, if so then what about the status of my wife...?

Question 2: If EAD is not an option and I have to continue working on a h1, then If I transfer my H1 to someother company, then will it affect my GC application, Can I still add my wife to GC application when dates are current,,?

Question 3 : How can my current employer can affect me , and how can I use AC- 21 portability act..

Question 4 : Or suggest me any other alternartives

You can stay in H1 until you get ur GC and your wife can stay in H4 until she gets her GC. You can transfer your H1B to the new company based on pending I-485, H4 extension is also granted. If your present company is a consulting firm, take proper precautions on how to execute AC-21 and H1 transfer. For more information look at AC-21 thread.

Whenever you get your 485 approved you can file for follow to join for your spouse. Depending on the priority date she will be here in about 3-6 months if the PD is current.
