hi. i am a permanent resident of the US. i am set to marry my fiance who is currently on a multiple entry tourist visa. what is the best option for us? can he stay legally and wait here in the US while he waits for my petition? does it matter whether we get married here in the US or abroad?

As a PR you can sponser your spouse and file for I-130. But he needs to wait for visa number before he can file I-485.

He needs to maintain his status till he is eligible to file I-485.

since he only has a tourist visa he may not be eligible to stay and wait

he needs to get something else like a student visa.

I would suggest getting married here because it is way easier to verify and way easier to get and you don't have to translate it.

apparently a lot of people do it this way

and they get their gc's no problem

however I still say that this is risky
