Need Advice on Name Check

I was unable to track the status of my application online, so I called USCIS and spoke to the supervisor. She mentioned that they are waiting on the results of FBI name check. So I have a couple of questions:

1. Will they issue the work permit (EAD) only after getting the results of the name check?
2. Is there any way to call FBI to find out the status?
3. I am just worried that if I don't get my work permit and I get laid off, then my company would cancel my visa and I would have to return to my country. So if I get laid off, can I get USCIS to expedite my application or give me the work permit card?

Thanks in advance

just up to my knowledge:

1) they issue EAD based on fingerpritning you will get letter to appear, after fingerpritning it take up to 90 days to get your EAD card, assuming that those fingerprints wont trigger anything serious. you do not need a full FBI background check in order to get EAD card, mine FBI background is pending over 3 years, I got 3 EAD card since then

2) there are some numbers to call but even if you get somebody to tell you that status, it wont give you anything - USCIS needs to do their background they are not going to accept any letter even official from you from FBI stating you are good to go.

3) you expedite your case only if it is necessary a) most expedited requests are put down - take mine for example the supervisor USCIS officer from main office called USCIS in Orlando in order to expedite my case (it was not my request it was an official OP request) -- it was declined. b) keep in mind that they only look at expedite requests once. If you "burn it" with not solid reason, even if later on you got a good reason, they will tell you that you already tried to expedite your case, please dont send expedite requests anymore. You should get your work permit on time, if you dont then go on a infopass dont waste time (in my opinion) with calling them, explain they may give you letter to redo fingerprints even next day, that may help. otherwise it is up to employees you would be suprise sometime even 5,000 employees base companies dont check you EAD furthermore only once when you start, even though just to sleep better I request EAD each year and give a copy to my work.

Hope this helps...

EAD MUST be issues in up to 90 days from the date you submitted the application! Actually that's the rule published by USCIS. Fingerprints, name check etc. has nothing to do with it (assuming all docs are fine and you don't get eny RFEs). If you don't get EAD by that you may submit a request or go to infopass. Moreover if you don't get EAD within 75 days you can call USCIS and put a request. See here:

If your Form I-765, Application for Employment Authorization, has been pending longer than 75 days since you filed and you have not received a request for evidence or missed a scheduled appointment, call Customer Service at 1-80... for further assistance. Please note: The time between the mailing of a request for evidence and receipt of your response by USCIS does not count towards the 75 days. A missed appointment restarts this 75-day period.
You may want to check this Web site further for any notices (e.g., news releases, Updates, etc.) that address your type of case.
