Need advice on 2 485s

My spouse's PD will become current in June (EB3), in the mean time, my I140 got cleared, my lawyer suggested to file I485 (EB2) and said it has no impact on the other pending case. But my spouse's lawyer opposed it, said it would significantly slow down the case...

I need to make decision very soon, is it worth to file a new 485? should I just wait for my spouse's case - usually how long will this take? There is one thing worth to mention, my lawyer keeps screwing my case up since 98, otherwise I would not be in this position today.

Why do you want to file multiple 485. As far as I understand, this would not give you any advantage. Since any RFE or any queries that will come would be based on your immigration statuses or personal history.

Since 140 is already approved, the 485 process would be exactly the same for both cases. It would not matter whether it is based on your employment or your wife's employment.


I have seen people file mutliple 485 and getting them approved, but that was 4-5 years back. But now it has become difficult. I guess your lawyer just wants to make his money on the filing.

In my opinion, If you file multiple 485, it might slow down the case.

It also depends upon your EB2 PD. if the PD is older (before 2003 dec), I would suggest you can definitely wait. 3-4 months of difference in waiting to file 485 (EB2) would not hurt! I am sure in the meantime your 485 based on your wife's Eb3 would have cleared.

can't you just request USCIS to re-connect your existing 485 applications to your new I-140?....Interfile request or something...

I would say - wait a month or two to see if your existing 485 gets approved...

I would say - if you think, you have better chances with your EB2 - I140...just ask them to reconnect your existing 485 to this new I140....If I am not wrong, madgu-gc2005 did such a thing...I believe...he filed 2 485s...then withdrew 1 485..and requested to reconnect the existing 485 or something...
