N400 has been denied or statutorily ineligible for naturalization for the following reason(s)

Section 316 [8 U.S.C. 1427](a)

Title 8, Code of federal Regulation, Part 316.10(b)(3)(iii)

Section 237(a)(2)(E)(i)

Section 237(a)(E)(I)

This decision is made without prejudice towards filling of a new application in the future.

Questions:

1. Does this mean I can apply again in future?

2. Shall I appeal for hearing or just wait few more years before re-submitting new application?

3. Do you think CIS will send my file for deportation now?

4. will I be able to renew my green card again which is going to expire in 2008?

5. Will I have any problem in entering US if I travel outside to different contury.

I would really appreciate your valuable adivce and suggestion.

My File History
____________

I had my citizenship interview on 26th Jan 2006 at Charlotte North Carolina. Officer didn't make any decision and told I should get some reply from her within 6 months.

I was charged with Assault on Female and Communication Threats in Dec 2002 (North Carolina). Detained for 48 hours and released on secure bond. It was with my wife.

I received 12 months supervised probation under the differed prosecution and voluntary dismissals.

I signed MOTION/AGREEMNET AND ORDER TO DEFER PROSECUTION from.

Court also asked me to join change program for 6 months (June 2003). I completed change program in Dec 2003. After completing change program Case was volunteer dismissal in Dec 2003 so is probation (after 6 months)

USCIS normally requires at least 5 years good moral character after a disqualifying event such as a DUI, criminal conviction or the like. My advice would be to wait a little longer, get a good lawyer and try again in a year or two.

There shouldn't be any impact on your GC renewal since you do not have a felony conviction.

I second boatbod's suggestion. Please go with a experienced lawyer when you get into trouble with the law.

Just a few Questions:

What happened at the interview ? Did the officer say anything at the end of the interview why a decision is not made at that time ? On the N-652 what did the officer check off ?
