Appreciate your comments and guidance!!

One Desi company gave assurance to file MY green card labor without joining into their company. Did all the paper work and send the payment and waited for 5-6 months, finally found out that the labor was not filed. Now I need to get my money back. What to do?

Unless you have something in writing from the desi company, I do not think you can do much(atleast from INS perspective). You could explore/invite suggestions from ppl knowledgable about typical consumer rules/regulations though...
 
Sorry to hear this.
Unless you have something in writing I dont think you can do anything. I'm sure the company did not give anything in writing.
Hopefully it was not a big amount.

I have all the email communication including my check receipt response mail. Employer said they filed the labor.. But when I checked with the attorney, they are saying they don't have any details about my labor filing.
 
if you have paid by check you can always ask for your money back ... just write a letter to them asking them about status of LC & receipt of application they have made.. if nothing works out send them a letter asking your money back with details of checks you sent them & tell them you will go to court if they do not refund you...
 
the amount you may have given may be too small to fight in the court (based on lawyers perspective).

you may try using small claims court.

report to dol and uscis. they cannot help you get your money back but they will have a record of that company for their immigration fraud which will adversely affects their future labor or gc petitions. you may even report to the appropriate consulate location about their company.

document eveything about this company. deal only in email howmuch ever they force you to talk over the phone.

you may even consider reporting about that company and the person who dealed with to homeland security dept alleging their immigration fraud for abusing the immigration system for material benefits. they know that these type of companies may do anything for money which is a risk to this land. guess what will happen !?!?!??!

email them about your intend to complaint to government and request them to return your money in 1 week. if that company is headquartered in that state of california or illinois then the laws are more favourable to person like you (they have severe law to punish these kind of companies including its management)

They are saying "will send your money back". Hopefully they will send it quickly.
