I'm a J-1->F-1->H-1. My BF will become USC at the end of Oct 2005. We plan to get married right after Oct and file I-130, I-485, I-131.... My BF has tax returns for 3 years but his income is below 125%. I have my tax returns for 2 years (only graduate for 2 years) and my first year is below 125% but my second year is above 125%. We don't have any other relatives in US that could Joint Sponsor for us.

Please give us some advice on:
1. Do we qualify for including my income for Joint Sponsor?
2. If we do qualify, what should I do for the year that I was in school with no income?
3. Any advice if we do not qulify now? Should we wait for next tax return year to file?

Thanks

You can combine your income. He fills in I-864 and you fill in I-864A
2. If we do qualify, what should I do for the year that I was in school with no income? You can't do anything. They need tax returns for the last 3 years. But the important digits are from the last year. When me and my husband filed together, I also had only 2 years of tax returns. You should attach an explanation why you are missing 1 year (+ simply you haven't been present in the country at that time)
3. Any advice if we do not qulify now? Should we wait for next tax return year to file? You qualify now. Don't bother. If your combined income is 125% and above you qualify to file now.

GOOD LUCK

Thanks
