Need advice for H1 7th year extension -- please help!

My H1 is expiring on Jan 27th and I never applied for Green card since my husband applied 4 years back and it is still in process. My company has an approved labor which was certified in october ,but they have not received the approval letter yet.
My Question is Can I apply for I-140 regular processing with the request for duplicate LC and based on the I-140 reciept number can I apply for H1 7th year extension?
Please any advice is appreciated since I need to decide whether I have to change to H4 or can I continue on H1, since just 20 days left on H1
