Need advice for Feb interview

Hi all,

I need some advice. My interview is in the last week of feb, I had some legal problems here in USA but its getting settled and all the charges are getting dropped before i go for an interview to India. I want to know if mumbai consulate does background check in USA, and if so do they do it in advance of once i go for an interview. Also i want to know if consulate in San Francisco will do any background check here to issue PCC. My concern is that if any of these do background checks here in USA before my case
is disposed, I could be in trouble. Please advice. i\'m leaving in about two weeks and my legal case will be settled in about a weeks time.

Would really appreciate any advice.

U definately need to consult a lawyer on this one.
It all depends on what the charge was.

In any case , if you have already been scheduled for an
interview it means you got thru the FBI name check.
When you come back after CP , you are finger printed
at the airport , and a match is run across the FBI database.

Thanks for your response. So since the interview is already scheduled, do you think Mumbai consulate office will not run a background check and also San Francisco consulate, will they run any background check for PCC. My charges are getting dropped but i\'m not sure if it\'ll be expounched right away, so will that cause a problem at port of entry ??
I know immigration lawyer might have some answers but anyone\'s opinion here would be helpful.

Take whatever docs you have about the charges being dropped

and if the name check at the Consulate comes back with issues than you should have documents to prove that your charges have been dropped.

I think Name Check is done after you are scheduled.
 
PCC is done only from Indian authorities

So if your case is over here it shouldn;t affect the PCC from Indian consulate.

Thanks Patta & Rajesh for your insights. Local RPO from India has send their approval to indian consulate in SFO, so i\'ll be going to get my PCC this week but my charges will ge dropped officially sometime next week. So my doubt was will consulate in SFO do any background check to issue PCC or will they be ok with Indian RPO approval.
Also Patta what do you mean by they do name check after they schdule interview. Please respond.
 
Indian Mission gives you Police clearance for India ONLY

Indian embassey in CA has no access to FBI files and your legal trouble

I think Consular post does your "Name Check", the process to get FBI clearance for you, after they have sceduled you for the interview

Patta, so do you think they already must\'ve done the name check or will it be done sometime soon or just before my interview. My interview was first scheduled for september of 2001 for which I was intimated in august, at that time i didnt have any legal problem. I had to postpond my interview to take care of all that and now its been rescheduled for feb last week and i was intimated about the new date in Januray. So do you think they\'ll be doing name check now or its already been done when they scheduled it the first time.

I believe they do name check after they scedule you. In your case, since you have been sceduled in past, I would imagine you having a Name Check done then.
I am not sure if the same name check clearance will apply now or they will do it again.

Did you get any documentation from the authorities who are dropping your charges?

Also if charges were not of Moral nature(child abuse, rape) or Fraud (Money laundering, misrepresentation)related then you are OK.. Traffic issues and misdemeaners are never an issue
