Dear All,

I have received my labor and my HR deptt is filing for 140 (Chicago based company). So, its time that I indicate choice between 485 or CP. I would really appreciate if you can please comment on the questions below:

1. How long does it takes to get done with CP after 140 is approved? (Mumbai Consulate as I am originally from Bhopal which falls under Mumbai)

2. Can someone please briefly mention the 3-4 main steps in CP and the time each takes? I keep reading about AC, Packet 3, Packet 4 but do not understand the same

3. What are the risks of going with CP versus 485? Have there been any rejections that you know off?

4. Someone on the board had mentioned that his CP could have been faster if he had gone the "AC" route. What is this "AC" route? Do I have to indicate it at this stage?

As you can see, I am a real novice and would really appreciate all the help.

Regards,

1) answering your question "How Long ..."

--------------------------------------------
thanks to WatchTSC for his 'post'
-------------------------------------------
)INS sends I-140 approved file to NVC & notice the beneficiary,
2-4 weeks
2) NVC will sent packet3 to us
4-6 weeks
3) We send packet to St. Louis office (NVS gives address in packet3)
1-2 day
4) St. Louis sends to NVC
2-3 weeks
5) NVC send to consulate
4-8 weeks
6) Consulate schedules interview,
10-12 weeks
Total expected time from 1 to 5 = 5-6 months in normal case

Hi,

>>>>>2. Can someone please briefly mention the 3-4 main steps in CP and the time each takes? I keep reading about AC, Packet 3, Packet 4 but do not understand the same >>>>>>>
AC stands for Attorney Certified, which is accepted by Mumbai consulate, which is basically ur attorney prepares ur documents and certifies them and sends to Consulate. Packet 3 is sent by St.Louis after ur I-140 is cleared by ur local INS center, which they forward to them. Packet 4 is sent by ur Consulate(Mumbai)after ur review is done by NVC.

>>>>3. What are the risks of going with CP versus 485? Have there been any rejections that you know off?>>>>
There is no primarly rejections in CP unless a person has crimnal record or Some kind of medical dieseas or ur academic records are forged. It's the same with 485 too.

>>>>4. Someone on the board had mentioned that his CP could have been faster if he had gone the "AC" route. What is this "AC" route? Do I have to indicate it at this stage?>>>>
It;s the same as above, It's attorney Certified route.

localmadras: quick question

Thanks for everyone's inputs, specially the detailed steps from localmadras.

One thing I am still not clear about is whether the whole process (140 approval to GC completed) is 4-6 months or 4-6 months just to get to the interview stage and then another 4 months wait for the interview?

Also, can I travel out of US after 140 is accepted and CP has been filed for?

Would appreciate feedback
