Guys I am looking for a suggestion from all you Gurus, Presently my GC is under process (I-140 not approved as yet). I have got Advance Parole for my wife and me.
I still have 2yrs left in my H1-B but I changed the company so in my passport I have VISA from my previous company that expired on January 6, 2003. My wife was on H4 at that time so she has the same expire date on her passport under H4-VISA stamp. Now she has joined a company and her status is H1-B. My am planning to go to India for visit.
My questions are:
1. Should I use Advance Parole or H1-B while coming back to USA at POE.
2. Since revalidation is ending in July 6, 2004 in USA. Should I stamp my and my wife’s passport in India?
3. What would be the procedure for my wife’s passport stamping here in USA. Does she need to go for an interview as her passport still shows H4 Visa stamp and now she is on H1-B.
Please give me your expert suggestion as I don’t want to use AP as I understand by doing so My H1-B and My Wife’s H1-B will no more be valid.
